Has a Non-Competition Agreement Been Broken?
Non-competes take many forms, such as a covenants not to compete, not to solicit customers, and not to solicit employees.
In Oregon, a non-competition agreement between employer and employee must jump through a number of hoops for it to be enforceable. For example, the employer must inform the employee in a written employment offer received by the employee at least two weeks before the first day of the employee’s employment that a non-competition agreement is required as a condition of employment or, for an existing employee, the non-compete is required at the time of subsequent bona fide advancement or promotion.
If a former employee has broken a non-compete agreement and is engaged in competition with your business, we can help. At the law firm of Gordon L. Dedicated to Seeing That Contracts Are Enforced
A non-compete agreement is a contract. It is a legally binding agreement that can be enforced, if broken. We know how to enforce all types of non-compete agreements, including:
- Covenants not to compete. Has a former employee taken a trade secret, such as pricing information, and used it to compete with you? That is an example of a violation of a covenant not to compete.
- Non-solicitation agreements. Has a former employee approached one of your clients in an attempt to underbid you? That is an example of a violation of a non-solicitation agreement.
- Hands-off agreements. Has a former employee been approached by one of your clients and entered into a business relationship? That is an example of a violation of a hands-off agreement.
Employers, no matter how a former employee has violated a non-compete agreement, you have the right to take action. Our law firm is here to stand by your side. We will work hard to see that any damage done is repaired.
